These Promotional Terms & Conditions (“Terms”) govern the offer, booking, and use of the walking tours, workshops, gift cards, and related experiences (“Experiences”) promoted on this website by OtherWise Travel (P.IVA IT16281611000), with registered office at Via Traversa Nuova Marina, 8, 80133 Naples, Italy. By booking an Experience with us, you agree to these Terms.
1. Nature of our services
Our Experiences are single tourist services — guided walking tours and hands-on workshops lasting a few hours, without transport, accommodation, or other travel services combined with them. As such, they do not constitute a “package” or a “linked travel arrangement” within the meaning of EU Directive 2015/2302 on package travel, and the specific protections that Directive establishes for package holidays (such as insolvency protection or the Standard Information Form) do not apply to our Experiences. This does not affect any other consumer right you are entitled to under applicable law.
2. Bookings and payment
Experiences can be booked directly through our website by selecting your preferred date, tour, and number of participants. Full payment is generally required at the time of booking to confirm your place, unless stated otherwise on the specific tour page. You will receive a confirmation email with your booking details. Please check that the date, time, and number of participants shown are correct, and contact us promptly if anything needs correcting.
3. Prices, discounts, and gift cards
All prices are shown in euros and are per person, unless stated otherwise on the tour page. Youth aged 5–17 receive a 20% discount on the standard price; children aged 0–4 join free of charge; please indicate the ages of your group when booking so that we can apply the correct rate. Gift vouchers are valid for 12 months from the date of purchase, can be redeemed against any tour, and are not refundable for cash.
4. Cancellations, rescheduling, and no-shows
Unless a different policy is stated on the specific tour page, you may cancel your booking free of charge up to 48 hours before the start of your Experience and receive a full refund. Cancellations made less than 48 hours before the start time, and no-shows, are not eligible for a refund. If you need to change the date of your Experience, please contact us as early as possible: we will do our best to find an alternative date, subject to availability.
Please note that, under Article 16(l) of EU Directive 2011/83 on consumer rights, services related to leisure activities scheduled for a specific date or time — such as our tours — are exempt from the general 14-day statutory right of withdrawal that applies to most online purchases. The 48-hour free cancellation policy described above is a commercial policy that we choose to offer, and is generally more favourable to you than the statutory minimum.
5. Changes or cancellation by us
We reserve the right to cancel or reschedule an Experience for reasons beyond our control (see Section 8), for safety reasons, or if the minimum number of participants required for a group tour is not reached. In such cases, we will notify you as soon as possible and offer you the choice of a full refund or an alternative date.
6. Physical requirements and health
Our tours involve walking at a relaxed pace through the historic centre of Naples, including cobblestones, occasional stairs, and, for some Experiences, underground spaces. You are responsible for assessing whether an Experience is suitable for your own physical condition. If you or a member of your group has specific mobility needs, allergies, or health conditions relevant to the Experience (for instance, tours that include food or manual activities), please tell us before booking, so we can advise you honestly on whether the tour is a good fit and adapt where possible.
7. Group conduct and safety
Group sizes are limited as indicated on each tour page, in the interest of safety and the quality of the experience. We reserve the right to refuse or interrupt participation, without refund, in the event of behaviour that endangers the safety or enjoyment of the group, including participation under the influence of alcohol or drugs.
8. Weather and force majeure
Our tours generally run rain or shine. In the rare event that we need to cancel or reschedule an Experience for safety reasons — for example, extreme weather, public safety measures, or other events beyond our reasonable control — we will contact you as soon as possible to arrange a refund or an alternative date. We are not liable for any additional costs you may incur as a result, such as transport or accommodation, and we recommend that you consider travel insurance for this purpose.
9. Photography and marketing use
During our Experiences, our guides may take photographs or short videos for our own promotional use on our website and social media channels. If you would prefer not to be included in such material, please let your guide know at the start of the Experience, and we will respect your request.
10. Liability
We are responsible for organising and delivering the Experience with reasonable skill and care. Except where mandatory law requires otherwise, we are not liable for indirect or consequential losses, or for the acts of independent third parties not engaged by us. Nothing in these Terms limits any liability that cannot be excluded under Italian law, including liability for death or personal injury caused by our negligence.
11. Complaints
If something did not go as expected during your Experience, please let us know as soon as possible — ideally during the tour itself, or within a reasonable time afterwards — so that we can address it. You can reach us at info@otherwisetravel.com.
12. Governing law and jurisdiction
These Terms are governed by Italian law. Any dispute will be submitted to the competent Italian courts, without prejudice to any mandatory consumer protection rights that entitle you, as a consumer, to bring proceedings before the courts of your own country of residence within the European Union.
13. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes in our services or in applicable law. The version in force at the time of your booking will apply to that booking.
